Privacy Notice

UVI TECH S.A.P.I. DE C.V., (“KAVAK”), with address at Carretera Amomolulco-Capulhuac No. 1, Colonia El Panteón, Municipality of Lerma de Villada, C.P. 52005, State of Mexico, Mexico is responsible for the collection, use, storage, treatment, transfer and protection of the personal data of the holders (the "Holder", or the "Holders", as the case may be), in the terms of the Federal Law on Protection of Personal Data Held by Private Parties (the “Law”), its Regulations (the “Regulations”) and other applicable legal provisions (jointly, the “Data Protection Regulations”).

For the purposes of this privacy notice (the "Privacy Notice"), (i) "Personal Data" will be understood as that information concerning an identified or identifiable natural person, in accordance with the provisions of section V of Article 3 of the Law (the "Personal Data"); and (ii) "Sensitive Personal Data" those that affect the most intimate sphere of its Holder, or whose improper use may give rise to discrimination or entail a serious risk for it, that is, that may reveal aspects such as racial or ethnic origin , present and future health status, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions, sexual preference, in accordance with the provisions of section VI of Article 3 of the Law (the "Sensitive Personal Data") .

KAVAK adheres to the guiding principles of the protection of Personal Data and Sensitive Personal Data:

  • Legality: The treatment of Personal Data carried out by KAVAK will be carried out at all times in accordance with and in compliance with the provisions of the Data Protection Regulations.
  • Consent: The express consent, either in writing or through digital means, of the owner of the Personal Data and/or Sensitive Personal Data will be required for their treatment.
  • Information: Through this Privacy Notice, KAVAK informs the general public of the information regarding the existence and main characteristics of the treatment to which their Personal Data and/or Sensitive Personal Data will be subjected.
  • Quality: By virtue of this principle, KAVAK assumes that the Personal Data and/or Sensitive Personal Data that are processed in accordance with this Privacy Notice are accurate, complete, pertinent, correct and up-to-date. It will be understood that said Personal Data and/or Sensitive Personal Data processed by KAVAK, meet the above characteristics when they are provided by their owner.
  • Purpose: Personal Data and Sensitive Personal Data collected by KAVAK may only be processed in accordance with the purposes mentioned in this Privacy Notice.
  • Loyalty: KAVAK undertakes to treat Personal Data and Sensitive Personal Data, protecting the interests and privacy of the owner.
  • Proportionality: KAVAK will only request from the owners those Personal Data and Sensitive Personal Data that are necessary, adequate and relevant in relation to the purposes of KAVAK.
  • Responsibility: KAVAK is strictly responsible for all the Personal Data and/or Sensitive Personal Data that the owners share with it.

KAVAK uses the strictest security measures to care for, access, use and manage its own information and data, as well as the information and data of KAVAK employees, customers, suppliers and any other person, company or entity related to KAVAK. Likewise, it is worth mentioning that KAVAK uses the same security measures in relation to your Personal Data and/or Sensitive Personal Data as it does with its own.

This Privacy Notice is made so that KAVAK's privacy practices have adequate understanding for individuals through a format that can be easily read, understood and navigated. KAVAK makes the Privacy Notice available to you for your information, as well as your options on how the information is used:

  • Privacy Notice: Means this Privacy Notice.
  • CURP: Means the Unique Population Registry Code.
  • Biometric Data: Means the physical, physiological, behavioral properties or personality traits that are attributable to a single person and that are measurable.
  • Patrimonial or Financial Data: It is the information on the economic capacity, number and type of credit card, issuing institution, mortgage loans, movable loans and credit history of the holders who refer to the resources they possess and their ability to deal with to your debts in the event that an interest-bearing installment plan with reservation of ownership for the purchase of a used vehicle is authorized.
  • Sensitive Personal Data: Means those personal data that affect the most intimate sphere of its owner, or whose improper use may give rise to discrimination or entail a serious risk for it. In particular, those that may reveal aspects such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions, sexual preference are considered sensitive.
  • Personal Data: Means any information concerning an identified or identifiable natural person.
  • Telematics Data: Means the data obtained through GPS Systems that may refer to the location, speed, dead times, acceleration or sudden braking, fuel consumption, vehicle failures and any other derived from the use , operation and condition of the vehicle
  • ARCO Rights: Means the rights of access, rectification, cancellation and opposition.
  • KAVAK: Means UVI TECH, S.A.P.I. of C.V.
  • Law: Means the Federal Law on Protection of Personal Data Held by Private Parties.
  • Data Protection Regulations: They mean, jointly, the Law, the Regulation, and the other applicable legal provisions regarding Personal Data and Sensitive Personal Data.
  • Regulation: Means the Regulation of the Federal Law on Protection of Personal Data Held by Private Parties.
  • RFC: Means, Federal Registry of Taxpayers.
  • RPC: Means, Public Registry of Commerce.
  • GPS Systems or GPS: Means Geographical Positioning System (in English Global Positioning System).
  • Holder or Holders: Means the owner of the Personal Data or Sensitive Personal Data.
